FEVER PILATES – TERMS & CONDITIONS

Welcome to FEVER Pilates. By purchasing classes, memberships, class packs, attending classes, using our facilities, or participating in any FEVER event, you agree to the following Terms & Conditions.

1. ASSUMPTION OF RISK

Participation in Pilates, fitness classes, heated fitness classes, strength training, workshops, private sessions, open gym sessions, and any other activities offered by FEVER involves inherent risks, including but not limited to:

  • Muscle strains and sprains

  • Falls or loss of balance

  • Heat-related illness

  • Dizziness or fainting

  • Aggravation of pre-existing injuries or medical conditions

  • Serious injury, disability, or death

You voluntarily participate at your own risk and assume full responsibility for any injuries or damages that may occur.

2. HEALTH & MEDICAL CONDITIONS

By attending FEVER, you represent that:

  • You are physically capable of participating in fitness activities.

  • You have consulted a physician regarding any medical conditions that may affect your participation.

  • You will inform the instructor of any injuries, limitations, pregnancy, recent surgeries, or medical concerns prior to class.

If at any time you feel dizzy, lightheaded, nauseous, overheated, or otherwise unwell, you agree to stop exercising immediately and notify a staff member.

3. HEATED CLASS ENVIRONMENT

Many FEVER classes take place in a heated room.

Participants acknowledge that:

  • Room temperatures may exceed 100°F.

  • Heat levels may vary from class to class.

  • Hydration before, during, and after class is strongly encouraged.

  • Participation in a heated environment may increase the risk of dehydration, dizziness, or heat-related illness.

You assume all risks associated with exercising in a heated environment.

4. PREGNANCY

Participants who are pregnant must obtain clearance from their healthcare provider prior to attending classes.

Pregnant clients acknowledge that:

  • Participation is entirely voluntary.

  • FEVER instructors are not medical professionals.

  • Modifications may be suggested but cannot guarantee safety for any individual pregnancy.

5. MEMBERSHIPS & CLASS PACKS

Memberships

Memberships automatically renew on a recurring monthly basis unless otherwise stated.

Members authorize FEVER to charge the payment method on file for recurring membership dues.

Class Packs

  • Class packs are non-transferable.

  • Class packs have no cash value.

  • Expiration dates, if applicable, will be disclosed at purchase.

Promotional Offers

Introductory offers, promotional rates, founding member rates, and special pricing may be subject to separate terms and are available only during designated promotional periods.

6. CANCELLATION & LATE CANCEL POLICY

Classes must be canceled at least 8 hours prior to the scheduled start time.

Failure to cancel within the required window will result in:

  • Loss of the class credit for class pack holders, and/or

  • A late cancellation fee for members, as outlined in FEVER's current pricing policy.

No-shows may be subject to additional fees.

Policies may be updated at FEVER's discretion.

7. REFUND POLICY

All sales are final.

This includes:

  • Memberships

  • Class packs

  • Workshops

  • Events

  • Retail merchandise

  • Private sessions

No refunds, credits, or extensions will be issued except where required by law or approved by management under exceptional circumstances.

8. WAITLIST POLICY

Clients who join a waitlist may be automatically added to class if a spot becomes available.

Once added to class:

  • Standard cancellation policies apply.

  • Clients are responsible for monitoring their reservation status.

9. STUDIO ETIQUETTE

To maintain a safe and respectful environment, participants agree to:

  • Arrive on time.

  • Follow instructor directions.

  • Respect staff and fellow clients.

  • Refrain from disruptive behavior.

  • Use equipment only as instructed.

FEVER reserves the right to remove any participant whose behavior is unsafe, disruptive, abusive, or inappropriate.

10. PERSONAL PROPERTY

FEVER is not responsible for lost, stolen, or damaged personal belongings.

All personal property brought onto FEVER premises is at the owner's sole risk.

11. PHOTOGRAPHY & MEDIA RELEASE

By entering FEVER facilities or attending FEVER events, you grant FEVER permission to photograph, record, or capture your likeness for marketing, advertising, social media, website content, and promotional materials.

If you wish to opt out of photography, you must notify management in writing before participating.

12. MINORS

Participants under 18 years of age must have written consent from a parent or legal guardian.

FEVER reserves the right to establish minimum age requirements for specific classes or events.

13. OPEN GYM & EQUIPMENT USE

Clients utilizing FEVER's Open Gym, weight room, or other self-guided fitness areas acknowledge that:

  • They are exercising without direct supervision.

  • They are responsible for using equipment safely and properly.

  • FEVER is not responsible for injuries resulting from improper use of equipment.

14. RELEASE OF LIABILITY

To the fullest extent permitted by law, you hereby release, waive, discharge, and hold harmless FEVER Pilates, its owners, employees, contractors, instructors, agents, affiliates, successors, and assigns from any and all claims, liabilities, demands, damages, losses, costs, or expenses arising from or related to participation in FEVER activities or use of FEVER facilities.

15. INDEMNIFICATION

You agree to indemnify and hold harmless FEVER Pilates from any claims, damages, liabilities, costs, or expenses arising from:

  • Your participation in FEVER activities,

  • Your violation of these Terms & Conditions, or

  • Your negligent or intentional actions.

16. RIGHT TO REFUSE SERVICE

FEVER reserves the right to refuse service, suspend memberships, revoke class privileges, or remove participants from the premises for violations of studio policies, unsafe behavior, harassment, or conduct detrimental to the FEVER community.

17. CHANGES TO TERMS

FEVER may modify these Terms & Conditions at any time. Updated versions will be posted through FEVER's website, booking platform, or studio communications. Continued participation constitutes acceptance of any revisions.

18. GOVERNING LAW

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of California.

By purchasing, booking, or attending any FEVER class, event, workshop, membership, or service, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
